Preamble

The services offered on the “https://www.tourazur.com” website are provided by CPC AZUR.

Tourazur.com offers transport services, in particular:

Transfers from Nice Airport to all destinations in light 7- and 8-seater Mercedes Minivans.

Car rental with driver for a flat rate per kilometer

Seat-only tours in light 8-seater Mercedes Minivans accompanied by a driver-guide, hereinafter referred to as the “Transport Services”.

CPC AZUR is a Société A Responsabilité Limité (limited liability company) with capital of 35,000 Euros, headquartered at 988 Avenue du Loubet, 37 domaine Saint Andrieu 06270 VILLENEUVE LOUBET, registered with the Nice Trade and Companies Registry under number 844 836 601, holder of the Domestic Operating License: 2024/93/0000325 and holder of the Certificate of Registration with the Registry of Operators of Chauffeur-driven Transport Vehicles: EVTC006190023.

Financial guarantee: Tourazur.com has taken out insurance with AXA France IARD, SA 313, Terrasses de l’Arche 92 7727 Nanterre Cedex, for bodily injury, property damage and consequential loss resulting from its professional activity.

Chapter I General information

Article 1. Definitions and scope of application

1.1. Definitions

“Order” refers to any reservation made and validated by the User on the www.tourazur.com website.

“Specific Conditions” refers to the contractual conditions specific to each Service (whatever they may be called: “conditions and restrictions”, etc.) accessible on the Site prior to confirmation of any Order.

“Partner” means any provider of Services.

“Service” means a provision of services, such as the provision of Transfers, chauffeur-driven vehicles, tours à la place, etc.

“Site” refers to the www.tourazur.com website, published by CPC AZUR.

“You” or “the User” refers to any person using the Site, in particular to reserve or order any Service offered by tourazur.com.

1.2. Scope of application

These general terms and conditions of sale and use (hereinafter the “General Terms and Conditions”), together with the Specific Terms and Conditions applicable to each Service, apply to all use of the Site, in particular to the marketing of all Services offered through the tourazur.com Site.

They are valid from April 01, 2024. This edition cancels and replaces all previous versions.

The User is invited to carefully read these Terms and Conditions, which are referenced by hyperlink on each page of the Site. The User is advised to download and/or print them and keep a copy. The User is also advised to read these Terms and Conditions each time he/she visits the Site, as they may be amended from time to time. Such changes will not apply to reservations previously made and confirmed by tourazur.com.

Article 2. Use of the www.tourazur.com website

The reservation of Services is reserved for Users who have read and accepted these General Terms and Conditions in their entirety, as well as the Specific Terms and Conditions for each Service, prior to each Order, by clicking on them or, if applicable, by telephone.

The Site consists of a Reservation Area, which designates the part of the Site, accessible without restriction, where all the Services are offered.

2.1. Use the Reservation Area

Terms of use

To use the Reservation Area, You must be at least 18 years of age, be legally capable of entering into a contract and use this Site in accordance with these Terms and Conditions.

You are responsible for the use of the Site made both in your name and on behalf of third parties, including minors, unless you can demonstrate fraudulent use resulting from no fault or negligence on your part.

You warrant the truthfulness and accuracy of the information provided by You or any third party using Your data on this Site.

Fraudulent use of the reservation service on this Site or use that contravenes these Terms and Conditions may result in tourazur.com refusing to allow You access to the Services offered on the said Site at any time.

Ordering

You may order the Services available on the Site after having read these General Conditions and the Specific Conditions.

The Ordering procedure includes at least the following stages:

You perform a search.

Following your request, the Site will send You one or more offers of Services.

Click on the Service(s) of your choice and complete the contact form to book.

You must then make sure that all the information displayed conforms to your specifications (date, time, origin and destination of your shipment, delivery method and address, price, identity, etc….).

Tourazur.com shall send You, as soon as possible, and in any event within five days of your Order, by e-mail, an acknowledgement of receipt confirming your Order, including the essential elements such as the identification of the Service ordered, the price and the quantity.

All information contained in this Order confirmation e-mail shall be deemed to constitute the agreement between You and Tourazur.com, if You have not contested it by registered letter with acknowledgement of receipt within 8 days. They may only be contested insofar as they differ from the Order You have placed.

In the event that You do not receive an Order confirmation, it is Your responsibility to contact Tourazur.com in accordance with Article 8.

It is your responsibility to ensure that the information (identity, e-mail address, postal address, etc.) that You provide when making your request is correct, and to inform tourazur.com immediately, by telephone on +33 4 93 44 88 77 or via the electronic form on the Site, of any change that may affect it, in order to enable them to ensure that You will benefit from the Services that You have ordered.

Order cancellation

All cancellation, modification and/or refund conditions are defined in the present General Conditions for each type of Service, and/or in the Specific Conditions applicable to each Service.

Please note that some Services cannot be cancelled or modified. You will be informed of this before your Reservation is validated.

2.2. Delivery

Unless otherwise stipulated in the Specific Conditions, tickets and/or transport documents issued for a Service ordered on the Site are sent by e-mail to the e-mail address given at the time of your request, in accordance with the provisions stipulated for each type of Service in the Specific Conditions.

2.3. Proof

It is expressly agreed that, in the absence of manifest error on the part of Tourazur.com, the data stored in Tourazur.com’s information system, in particular in the electronic messaging tools used by Tourazur.com, or in the order confirmation control systems, have evidentiary value with respect to past reservations and the performance of the parties’ obligations. Data on computer or electronic media kept by Tourazur.com constitute proof and, if produced as evidence by Tourazur.com in any litigation or other proceedings, will be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative force as any document that would be established, received or kept in writing.

2.4. Right of withdrawal

Services booked on the Site are subject exclusively to the cancellation and modification conditions set out in these General Conditions and/or in the applicable Specific Conditions.

Chapter II General conditions applicable to the services offered by tourazur.com

Transport services are offered by Tourazur.com.

All the Specific Conditions relating to the provision of Transport Services are accessible at the time of your Order. These Specific Conditions form an integral part of these General Conditions and must be read carefully and in their entirety before any Order is placed.

Prices are per person. All tours are confirmed for a minimum of 2 participants.

Article 3. Transport services

3.1. Tours and Chauffeur-driven Car Service

Tours are offered in air-conditioned 8-seater Mercedes minivans with commentary provided by a Driver/Guide.

Tours depart from downtown Cannes and Nice as indicated. No departure from a port or cruise ship is permitted.

The language required must be specified when booking the service. Tours can only be guaranteed in English and French. Other languages on request.

Our drivers/guides are not obliged to accompany customers on sightseeing tours or inside tourist monuments. Site visit times will be given by the driver on arrival at the sites and in accordance with the tour in progress.

All personal belongings are the sole responsibility of the customer.

The customer’s hotel or place of residence is the point of departure and return of the service.

The maximum waiting time for the driver is 15 minutes after the official departure time.

Departure and return times may vary according to traffic conditions or other unforeseen circumstances.

Tour Azur cannot be held responsible for bad weather. We cannot be held responsible for delays due to the above-mentioned traffic conditions, other unforeseen circumstances or customer delays.

Unless otherwise specified, each Tour requires a minimum of two people. For departures from Cannes, a minimum of 4 people is required.

Unless otherwise indicated, meals and entrance fees for tourist sites are not included in the Service price.

Discounts cannot be combined with any other form of discount.

A supplement per person is charged for pick-ups and drop-offs outside the above-mentioned city limits.

A discount for children under 12 is granted subject to availability and provided they are accompanied by two adults paying full price.

Prices include fuel, freeway tolls, parking and driver’s fees.

If the time allotted to the service is exceeded, overtime will be charged at the current rate. (Please note that this condition does not apply to Tours à la place).

For Tours à la place, a supplement is applied to customers departing from Cannes

3.2. Transfers

Arrivals: Meet and greet service is provided at the airport arrivals terminal at the scheduled flight arrival time. Tour Azur will use a welcome sign bearing the customer’s name. Departure is immediate, with a maximum waiting time of 40 minutes. The customer will then be taken to his hotel or place of residence. Refreshments are provided for all transfers outside Nice. In the unlikely event that you have difficulty finding your driver, it is extremely important that you call the following number: +33 4 93 44 88 77.

Departures: The time and place of pick-up from the hotel or place of residence declared at the time of booking will be reconfirmed with the driver when the customer arrives at the airport. Customer drop-off at the airport will be at the appropriate terminal depending on the airline. Full payment will be due for all no-shows. At the time of pick-up, if a customer is more than 1 hour late, the customer will be charged a waiting fee. These additional costs must be paid before the vehicle leaves.

3.3. Ticket, voucher or coupon

You will receive a personal Tourazur service confirmation by email for each tour, event or service booked.

To obtain your tour, ticket or package, you must provide the driver concerned with the original, authentic Tourazur voucher. Your reservation will not be honored without presentation of a valid voucher.

For security reasons, when you hand in your Tourazur voucher, you must present valid photo identification and sign the Tourazur voucher. This is required for identification purposes and to prevent fraud.

Please note that your vouchers may be confiscated (and immediately cancelled without refund) if your signature or name do not match those on your payment card.

3.4. Cancellation conditions

Cancellation of a reservation with Tourazur.com may result in charges as described below. If you cancel your booking, you will be informed by e-mail or telephone of the exact amount of the cancellation charge.

Cancellation fees for Transport Services

If you cancel at least 48 hours before the scheduled departure or start time, no cancellation fee will be charged.

If you cancel between 48 hours and 24 hours before the scheduled departure or start time, a 50% cancellation fee will be applied.

If you cancel within 24 hours of the scheduled departure or start time, a cancellation fee of 100% will be applied.

Chapter III Financial conditions

Article 4. Financial terms and conditions

4.1. Prices and taxes

The descriptions of the Services presented on the Site specify, for each Service, the elements included in the price.

Prices are given in Euros.

Prices for Services are generally understood to include all taxes, fees and related service costs. The costs and service charges correspond to the costs related to the Services booked by the User, borne by the Partners and in particular indirect taxes (VAT, other similar taxes) and other costs required to process User Orders.

Please note that certain taxes or additional charges (tourist tax, tourist tax, visa and/or tourist card fees, etc.) may be imposed by the authorities in certain countries. They are not included in the price of the Services. Additional taxes, if any, are at your expense and may have to be paid locally.

In addition, in general, and unless expressly stated otherwise, prices do not include all expenses of a personal nature or incidental to the service, such as insurance, excess baggage charges, vaccination costs, telephone calls, drinks, meals, tips, and more generally any service not expressly included in the booking confirmation.

4.2. PRICE PAYMENT

The payment of the price of the Services that You reserve, in the Reservation Space, intervenes either as from the day of the Order.

For sales, the total amount of the Service (including handling fees) will be debited when your Transport documents are made available.

Payment is made directly when you place your Order, by communicating your credit card number via a secure payment system.

Unless otherwise stipulated in the Specific Conditions, payments to Tour Azur are made by credit card (Carte Bleue, Visa, Eurocard/Mastercard are accepted) via a secure payment system.

Should payment prove to be irregular, incomplete or non-existent, for a reason attributable to You, the sale of these Services will be cancelled, the resulting costs being borne by You, and civil and/or criminal proceedings may, where appropriate, be taken against You.

Chapter IV Miscellaneous

Article 5. Insurance

No insurance is included in the prices quoted on the Site.

Tourazur.com therefore recommends that you take out an insurance policy covering the consequences of certain cancellations and an assistance policy covering certain specific risks, in particular repatriation costs in the event of accident or illness.

Article 6. Information and complaints

All requests for information, clarification and order tracking should be addressed to Tourazur.com Customer Service, using the electronic form on the Site or by telephone on +33 4 93 44 88 77.

Complaints should be addressed to Tourazur.com Customer Service by mail to Tour Azur / CPC AZUR MIN Saint Augustin PAL 5 06296 NICE Cedex 3.

Complaints will only be accepted insofar as the difficulties to which they relate have been reported to Tourazur.com during the performance of the Service, so that Tourazur.com can attempt to remedy them in order to limit the prejudice that You may suffer.

Please note that no claim for loss, damage or theft of luggage, clothing or personal items during the service will be accepted if it is the result of fault or negligence on your part.

Article 7. Intellectual property

Tourazur.com, the companies in their group or their Partners hold all intellectual property rights relating to the Site which belong to them or hold the related usage rights.

Access to the Site does not give You any right to the intellectual property rights relating to the Site, which remains the exclusive property of Tourazur.com or the companies in their groups or their Partners.

The elements accessible on the Site, notably in the form of texts, photographs, images, icons, maps, sounds, videos, software, databases and data, are also protected by intellectual and industrial property rights and other private rights held by Tourazur.com, its affiliates or its Partners.

Except as provided in these Terms and Conditions, You may not, under any circumstances, reproduce, represent, modify, transmit, publish, adapt, in any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Site without the prior written consent of Tourazur.com. You are hereby informed that this prohibition applies in particular, but not exclusively, to practices such as scrapping or the use of robots for the purpose of extracting or reproducing any element of the Site, including the Service offers presented therein, in particular for commercial purposes.

Any use of all or part of the Site not previously authorized by Tourazur.com, for any reason whatsoever, may give rise to any appropriate action, in particular an action for infringement.

Only the use of a non-substantial part of the Site is authorized for strictly private and non-commercial purposes.

The insertion of hypertext links to any part of the Site is prohibited without the prior written consent of Tourazur.com.

Article 8. Liability and warranties

8.1. To use the site

Tourazur.com does not guarantee that the Site will be free of anomalies, errors or bugs, nor that these can be corrected, nor that the Site will function without interruption or breakdown, nor that it is compatible with any particular hardware or configuration other than those expressly mentioned by Tourazur.com.

Tourazur.com is in no way responsible for malfunctions attributable to third-party software.

In no event shall Tourazur.com be liable for any foreseeable or unforeseeable damages, material or immaterial (including loss of profits or opportunity…) arising out of the use or total or partial inability to use the Site. Finally, as Tourazur.com cannot control all the sites to which it refers via hypertext links, which exist solely to facilitate the User’s research, Tourazur.com is in no way responsible for their content.

You declare that you are aware of the characteristics and limits of the Internet, in particular its technical performance, response times for consulting, querying or transferring data and the risks associated with the security of communications.

You acknowledge that you have checked that the computer configuration you are using is virus-free and in perfect working order.

8.2. For services

Tourazur.com will check with the Partners to ensure that the Services provided under the contract entered into with You are carried out correctly. However, in no event shall the company be liable for any failure to perform or improper performance of all or part of the Services provided under the contract, which is attributable either to your fault, or to the unforeseeable and insurmountable fault of a third party unrelated to the Service, or to a case of force majeure.

Article 9. Personal data protection

The information You provide on the Site enables Tourazur.com to process and execute reservations made via the Site and, where applicable, to manage the operation of the Customer Area.

In accordance with Article 32 of the French Data Protection Act of January 6, 1978, Tourazur.com.com informs you of the use that is made of personal data collected in the context of your Orders concerning You.

To this end, Tourazur.com permanently provides you with a “Privacy Policy”, accessible via a hypertext link at the bottom of every page of the Site.

We therefore invite you to read this Privacy Policy.

Article 10. Applicable law and jurisdiction

These Terms and Conditions, and more generally the contract that You enter into with Tourazur.com, are governed by French law.

Any dispute relating to their interpretation and/or execution shall be referred to the French courts.

In the absence of an amicable settlement of a claim relating to the Transport Services, only CPC AZUR may be taken to court.

Article 11. Final provisions

Should any provision of the General Terms and Conditions be declared null and void or ineffective, it shall be deemed unwritten, without affecting the validity of the other provisions, unless the provision declared null and void or ineffective was essential and decisive.

Any case of force majeure making it impossible to perform the service, including interruption of telecommunications, strikes by carriers, hoteliers, air traffic controllers, extinguishes the obligations of Tourazur.com affected by the case of force majeure. Services not performed due to force majeure will be reimbursed. However, such non-performance shall not give rise to any claim for damages.
